Terms and Conditions

GENERAL TERMS AND CONDITIONS ELITE TRAINERS B.V.

These General Terms and Conditions apply to all services and memberships of Elite Trainers B.V. and take effect on December 1, 2025.

Article 1 – Definitions

In these conditions, the following terms are understood as:

1.1. Elite Trainers: Elite Trainers B.V., the legal entity offering Memberships and related services.
1.2. Member: The natural person, who is not acting in the exercise of a profession or business, and who enters into a Membership with Elite Trainers.
1.3. Services: The activities offered by Elite Trainers, including but not limited to Personal Training (PT), Semi-Personal Training (SPT), and the option for Free Training (Open Gym/OG), aimed at improving physical and/or mental health.
1.4. Membership: The agreement between Elite Trainers and the Member regarding the purchase and use of the Services and facilities.
1.5. Credits: The internal value system by which the Member gains access to specific Services. Credits have a limited validity period and are linked to the chosen Membership.
1.6. In Writing: Communication on paper or digitally (e.g., email, via the app or the online portal).
1.7. House Rules: The rules of conduct, safety regulations, and conditions of use for the facilities established and communicated by Elite Trainers, which are an integral part of the Membership.

Article 2 – Applicability and Amendment

2.1. These conditions apply to all offers, agreements, and legal relationships between Elite Trainers and the Member.
2.2. Deviations from these conditions are only valid if explicitly agreed upon In Writing.
2.3 Elite Trainers is entitled to unilaterally amend these General Terms and Conditions, insofar as there is a reasonable ground for amendment. Reasonable grounds include, but are not limited to:
a. changes in relevant legislation, regulations, or case law;
b. changes necessary for the safety or the proper provision of the Services;
c. organizational or operational reasons that justify an adjustment of the conditions;
d. changes that do not have a material impact on the rights and obligations of the Member.

Article 3 – Membership, Duration, and Renewal

3.1. Commencement and Duration: The Membership starts on the agreed start date and has a minimum duration in accordance with the chosen subscription, as stated in the Membership Agreement and/or the app/portal.
3.2. Automatic Renewal: After the minimum duration, the Membership is tacitly continued for an indefinite period. This renewal occurs for a term of four (4) weeks, unless timely notice of termination has been given in accordance with Article 5.
3.3. Personal Nature: The Membership is strictly personal and cannot be transferred to third parties without the prior, express, and Written consent of Elite Trainers.
3.4. Credits: The Membership entitles the Member to a fixed number of Credits per period, as specified in the chosen package. Credits expire at the end of the four-week period in which they were granted and are not transferable to a subsequent period, unless otherwise agreed upon In Writing.
3.5. Identification: Elite Trainers is at all times entitled to ask the Member for identification for control purposes and to prevent misuse of the Membership.

Article 4 – Membership Fees, Payment, and Price Changes

4.1. Payment: The Membership Fees must be paid in advance via SEPA direct debit. By entering into the Membership Agreement and/or activating the app/portal, the Member grants the direct debit authorization to Elite Trainers.
4.2. Collection and Default: If the automatic direct debit fails, Elite Trainers will send the Member a Written reminder, usually by email, with a digital payment link (e.g., iDEAL). Elite Trainers will thereby give the Member a period of fourteen (14) days to pay. If payment is not received after this period, the Member is in default without further notice of default. Elite Trainers is then entitled to:
Transfer the claim for collection to a collection agency, whereby all extrajudicial collection costs (these are calculated in accordance with the Wet Incassokosten (WIK) - Collection Costs Act) and statutory interest will be charged to the Member.
Suspend access to the Services and facilities (in accordance with Article 4.3).
4.3. Suspension in case of Payment Arrears: In case of payment arrears, Elite Trainers is entitled to deny the Member access to the Services and facilities or to temporarily suspend the Membership until the full outstanding payment has been made. The Member's payment obligation remains in effect during the suspension.
4.4. Price Changes: Elite Trainers is entitled to adjust the rates for the Memberships.
Article 5 – Termination and Interim Termination

5.1. Termination by the Member: After the expiry of the minimum duration, the Member can terminate the Membership at any time In Writing with due observance of a notice period of at least one (1) full payment period (four weeks), calculated up to the end of a current four-week period.
5.2. Untimely Termination: If notice of termination is not given on time, the Membership will be automatically extended by four (4) weeks, after which the termination will still take effect at the end of that extended period.
5.3. Interim Termination (Member): The Membership can only be terminated prematurely and free of charge:
a) Medical Grounds: Based on demonstrable medical grounds, substantiated by a Written statement from a treating medical professional showing that exercising is impossible for the remainder of the term.
b) Relocation: In case of a demonstrable relocation outside a radius of ten (10) kilometers from the nearest studio/location of Elite Trainers. The Member must provide proof of registration at the new address.
5.4. Dissolution by Elite Trainers: Elite Trainers is entitled to dissolve the Agreement with immediate effect in case of:
Repeated payment defaults.
Serious violation of the House Rules.
(Repeated) inappropriate or undesirable behavior towards staff or other Members.
5.5. Evaluation: After deregistration, Elite Trainers may ask the Member to voluntarily complete an evaluation form. Participation in this is not a condition for termination.
Article 6 – Pausing the Membership (Suspension)

6.1. Grounds and Periods for Pausing: Pausing the Membership is only possible In Writing and with the prior approval of Elite Trainers on the following grounds:
a) Medical Pause: Allowed for a maximum of two (2) months per event, with Written medical evidence.
b) Pregnancy: Pause allowed for a maximum of six (6) months, with proof from a doctor or midwife.
c) Holiday/Other: Possible for a maximum of four (4) weeks per calendar year, with prior approval and Written application.
d) Open Gym: Subscriptions that exclusively include the Free Training (Open Gym) service cannot be paused.
6.2. Effect of Pausing on Duration and Credits: The pause period is fully added to the remaining minimum duration of the Membership; the end date shifts by the duration of the pause. After resuming the Membership, the Member must notify In Writing which Credits have expired unused during the Pause. These expired Credits will then be restored to the account with an unlimited validity period.
Article 7 – Liability and Insurance

7.1. Own Risk: Participation in the Services, training sessions, and the use of the facilities is entirely at the Member's own risk. Elite Trainers accepts no liability for injury, illness, loss, or damage of any nature, arising during or as a result of the training sessions or the use of the facilities.
7.2. Exclusion of Liability: Elite Trainers' liability for damage is limited to direct damage and is in any case excluded for indirect damage, consequential damage, and immaterial damage. Elite Trainers' liability is excluded, unless the damage is caused by intent or conscious recklessness on the part of Elite Trainers' management. The exclusion does not apply if damage has arisen due to a failure in Elite Trainers' duty of care.
7.3. Insurance: The Member is advised to take out appropriate (supplementary) insurance, including health and/or accident insurance, as well as contents and/or travel insurance for personal risks and property. Elite Trainers is not liable for theft or loss of the Member's property.

Article 8 – Medical Fitness

By accepting these General Terms and Conditions, the Member confirms that, to the best of his/her knowledge and without reservation, he/she is medically fit to participate in the offered physical training sessions and to use the facilities.
The Member is obliged to immediately consult a medical professional if there is any doubt about medical fitness and must inform Elite Trainers about this, if necessary, before resuming or starting the training sessions. Participation is at the Member's own risk in relation to their medical condition.

Article 9 – Privacy, Data Protection, and Camera Surveillance

9.1. Data Processing and Privacy: The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and the provisions of Elite Trainers' Privacy Statement, which is available on the website.
9.2. Camera Surveillance: Elite Trainers uses camera surveillance.
Purpose: Security of persons, property, and facilities.
Placement: Exclusively in general areas. The cameras are not placed in changing rooms, toilets, or other places where privacy is disproportionately compromised.
Notification: The Member is clearly informed in advance about the camera surveillance through clear signage.
Retention Period and Access: Camera images are stored for a limited period (no longer than necessary) and are only accessible to authorized persons.
Disclosure to Third Parties: Images are not shared with third parties, unless Elite Trainers is legally obliged to do so (for example, in the context of a police investigation).
Legal Basis: The processing of these images is based on the legitimate interest of Elite Trainers (in accordance with Article 6, paragraph 1, sub f of the GDPR).
Article 10 – Code of Conduct, House Rules, and Declaration of Agreement

Elite Trainers reserves the right to terminate the Membership with immediate effect in case of repeated misconduct, failure to follow instructions, or violation of the House Rules.
The Member declares, upon entering into the Membership, to agree to both these General Terms and Conditions and the House Rules. The House Rules are provided to the Member with the email in which the Membership, the General Terms and Conditions, and the House Rules are shared, and the agreement is digitally confirmed by the digital signature or by ticking the declaration of agreement upon registration.

Article 11 – Complaints and Communication

11.1. Complaints Procedure: Complaints must be reported to Elite Trainers (by email to info@elitetrainers.nl or via the app/portal) In Writing and with reasons as soon as possible and in any case within a reasonable time after the Member has discovered or reasonably should have discovered the shortcoming. Failure to report in time may result in the loss of the Member's rights in this regard.
11.2. Handling and Response Period: Elite Trainers will handle the complaint and provide a substantive response within fourteen (14) days of receipt. If a longer period is necessary, the Member will be informed of this In Writing within the initial period, with an indication of the period within which a definitive response can be expected.
11.3. Member's Duty to Report: The Member is obliged to immediately notify Elite Trainers In Writing of any changes in personal data, contact details, or payment details. Elite Trainers is not liable for damage resulting from incorrect or incomplete information provided by the Member.

Article 12 – Force Majeure and Facility Closure

12.1. Force Majeure: Force majeure is understood to mean any circumstance independent of the will of Elite Trainers that temporarily or permanently prevents or reasonably makes impossible the performance of the Agreement. This includes, but is not limited to: pandemics, (emergency) legislation, power outages, fire, water damage, utility failures, or unforeseen circumstances over which Elite Trainers has no (reasonable) influence.
12.2. Suspension and Exclusion of Refund: In case of force majeure, Elite Trainers is entitled to suspend its obligations or to (temporarily) cease, restrict, or adjust the Services and facilities. Elite Trainers is not liable for compensation in a case of force majeure. If the force majeure situation lasts longer than one (1) year, both parties have the right to terminate the Agreement prematurely, with compensation for Services already paid for but not enjoyed (after deduction of costs incurred), unless this is prevented by (emergency) legislation.

Article 13 – Applicable Law and Choice of Forum

13.1. Applicable Law: These general terms and conditions, as well as any Membership Agreement, are exclusively governed by Dutch law. The applicability of the Vienna Sales Convention (CISG) is expressly excluded.
13.2. Dispute Resolution: All disputes arising from or related to the Agreement and these conditions will be exclusively submitted to the competent court in Amsterdam. Elite Trainers reserves the right to summon the Member before the competent court of the Member's place of residence or actual stay.

House Rules

House Rules for Members – Elite Trainers

At Elite Trainers, we value a pleasant, safe, and tidy environment. These house rules are designed to ensure that everyone can train comfortably and without disruption. We count on your cooperation to make this possible.

Order and Tidiness
Clean up during and after use:

Return weights to their holders, not on machines.
Place dumbbells back in order in the rack.
Return accessories (such as attachments) to the machines or designated bins, not on the floor.
After your workout, check to ensure everything is left neat and tidy.
Personal belongings:

Bags, coats, shoes, and clothing should be stored in a locker or the changing room. This includes jackets or sweaters removed during your session.
Lounge cleanliness:

Eating is allowed only in the lounge, not in the workout areas. Leave the lounge clean and tidy for others.
No magnesium:

Both powdered and liquid magnesium are not allowed.
Hygiene and Safety
Sports shoes required:

Wear clean shoes designated for indoor use only.
Towel required:

Use a towel on every machine or surface where you sit or lie.
Cleaning equipment:

Clean machines after use with the provided spray and paper towels.
Spray the cleaning solution onto the paper towel, not directly on the equipment, and then wipe it down.
Dress code:

Shirts are mandatory. Training without a shirt is not allowed.
No bare feet:

Training in socks is acceptable, but ensure your shoes are not left in the way.
Behavior in the Gym
Handle weights responsibly:

Place dumbbells, barbells, kettlebells, and other weights down gently. Even during exercises like deadlifts, ensure weights are lowered in a controlled manner to avoid noise or damage.
Phone calls:

Phone calls are not allowed on the gym floor. Please use the lounge for calls and be mindful of others in the space.
Filming and photography policy:

Filming and photography are allowed under the following conditions:
Others must not be captured in your footage without their consent.
Inform those present before taking photos or videos.
If someone objects, wait until they leave the area before proceeding.
Collaboration and Respect
Share and collaborate:

If you’re resting between sets, allow others to use the equipment.
Communicate proactively and be flexible in sharing equipment.
Respect for others:

Be considerate of other members, trainers, and visitors.
Pet policy:

Pets are not allowed, except for service animals.
